L-1 Visa is a nonimmigrant Visa which allows foreign company’s executives, managers, or employees with specialized knowledge, to transfer to an office located in the United States, which is considered a parent, affiliate, subsidiary, or branch of the foreign company.
Additionally, L-1 Visa category requires for the person being transferred to have wo
rked for the foreign company, for at least one continuous year within the preceding three years.
To be eligible for the USA L-1 visa, both the employer and employee must meet certain criteria:
Employer eligibility:
- The employer must have a qualifying relationship with a foreign company, such as a parent, subsidiary, affiliate, or branch office.
- The employer must be currently doing business in the US and at least one other country during the entire period of the visa.
Employee eligibility:
- The employee must have worked for the foreign company for at least one continuous year within the past three years in a managerial, executive, or specialized knowledge capacity.
- The employee must be transferred to work in a managerial, executive, or specialized knowledge capacity in the US branch office.
- The employee must have the necessary qualifications and experience to perform the job duties in the US.
