Dual intent is a concept in Canadian immigration law that allows foreign nationals to apply for permanent residency while also holding a temporary visa, such as a work permit or study permit. This means that a foreign worker in Canada can apply for permanent residency while also continuing to work under their LMIA-approved work permit.

When it comes to LMIA applications, dual intent is not typically a factor in the assessment process. LMIA applications are evaluated based on the specific job offer and the labour market conditions in Canada. However, if a foreign worker is also applying for permanent residency, having a LMIA-approved job offer can be beneficial for their application as it demonstrates their ability to contribute to the Canadian economy.

To be eligible for a dual intent LMIA, an individual must meet the following criteria:

• They must have a valid job offer from a Canadian employer.
• They must be eligible for a work permit.
• They must also be eligible to apply for permanent residence in Canada through one of the economic immigration programs, such as the Federal Skilled Worker Program, the Federal Skilled Trades Program, or the Canadian Experience Class.

Additionally, the employer must be able to demonstrate that they have made efforts to hire Canadian citizens and permanent residents for the job before offering it to a foreign worker. The employer must also provide a detailed job description, pay a market wage rate, and meet other requirements as set out by Immigration, Refugees and Citizenship Canada (IRCC).
